Abstract:
This Royal Decree aims to provide a legal framework for equal pay for work of equal value, since it constitutes one of the essential elements of the principle of real and effective equality between women and men. So, this is related to economic power, because it aims to ensure equal pay between men and women. The structure and content of the royal decree responds to four chapters, eleven articles, four additional provisions, a single transitory provision and four final provisions. Chapter I, relating to the object and scope of application of the royal decree, consists of two articles. Article 1 refers to its purpose, described as the set of specific measures to enforce the right to equal treatment and non-discrimination between women and men in remuneration, and the development of the necessary mechanisms to identify the existence of gaps unjustified or discriminatory compensation. Article 2 refers to its personal scope of application, which includes labor relations regulated in the Workers' Statute. Chapter II defines two basic elements in their different substantive aspects to enforce the right to equal treatment and non-discrimination: the principle of transparency, which allows obtaining sufficient and significant information on the value and amount of remuneration, allowing deduction and identification possible discrimination, both direct and indirect; and the obligation of equal remuneration for work of equal value, providing all the data that must be taken into account for a correct valuation exercise. Chapter III develops in different sections the instruments that make the principle of remuneration transparency possible.
