Abstract:
Also known as FüPoG II (Führungspositionen-Gesetz II), is a proposed amendment to the existing Act on Equal Participation of Women and Men in Leadership Positions in the Private and Public Sectors, which was introduced in 2015 by BMFSFJ. FüPoG II aims to increase the representation of women in leadership positions in Germany (by building on the provisions of the original act), thus promoting the representation of women in the sphere of economic power. The proposed changes include extending the scope of the law, setting more ambitious targets for the representation of women in leadership positions. FüPoG II targets smaller companies with more than 50 employees, rather than the previous threshold of 500 employees, which means that smaller companies are now be required to set binding targets for the representation of women in leadership positions (e.g., setting quotas for the representation of women in leadership positions) and report on their progress towards these targets. The law allows for fines of up to 2% of the entity's annual revenue for non-compliance with the reporting requirements. The law also applies to public authorities and government bodies at all levels, including federal, state, and local government agencies, as well as universities and research institutions that receive public funding.
